1. Introduction

These Terms & Conditions apply to all products, services, quotations, invoices, subscriptions, websites, hosting, cloud services, and online purchases provided by Gill Tech Services (“we”, “us”, “our”) to our customers (“you”, “your”).

By requesting a quote, placing an order, making payment, or using our services, you agree to these Terms & Conditions.


2. Our Services

We provide a range of IT products and services including, but not limited to:

  • IT support and consulting
  • Microsoft 365 and cloud services
  • Computer, laptop and hardware supply
  • Networking equipment and installation
  • Website design and development
  • eCommerce website solutions
  • Domain registration, hosting and business email
  • Cybersecurity and IT solutions
  • Software, licensing and subscriptions
  • Ongoing IT maintenance and support

3. Quotes & Pricing

  • Quotes are valid for 7 days unless stated otherwise.
  • Prices may change due to supplier pricing, stock availability, exchange rates or manufacturer changes before an order is confirmed.
  • Orders are only confirmed once accepted by us and payment has been received where required.
  • Unless otherwise stated, prices displayed on our online store include GST where applicable.

4. Orders & Payment

  • Payment is due according to the invoice terms.
  • We may require full or partial payment before supplying goods or commencing work.
  • Ownership of goods remains with Gill Tech Services until full payment has been received.
  • Late payment may result in suspension or cancellation of services and recovery costs may be charged where permitted by law.

5. Products & Availability

  • Products are supplied through trusted authorised distributors and manufacturers.
  • Product images, specifications and availability are provided by suppliers and may change without notice.
  • Delivery dates are estimates only and are subject to supplier and courier availability.
  • We reserve the right to cancel or amend an order if a product becomes unavailable or pricing errors occur.

6. Shipping

  • Orders are dispatched after payment has cleared.
  • Delivery timeframes are estimates only.
  • Shipping is provided through third-party courier companies.
  • We are not responsible for delays caused by suppliers, couriers, weather events or circumstances beyond our control, but we will assist customers with tracking and courier enquiries where possible.

7. Returns, Refunds, Exchange & Warranty

  • Returns Policy
  • We accept returns for both defective and non-defective products within 14 days of delivery.
  • Non-defective items must be unused, unopened, and in original packaging. Special order, software, and clearance items may not be eligible for return.
  • All returns require prior approval and a Return Material Authorisation (RMA). Return shipping costs may apply for change-of-mind returns.
  • Faulty products will be assessed under the Consumer Guarantees Act 1993 and may be repaired, replaced, or refunded where applicable.
  • For assistance, please contact Gill Tech Services before returning any items.
  • Exchanges Policy
  • We accept exchanges for eligible products within 14 days of delivery.
  • Exchanges are available for defective items or incorrect products supplied by Gill Tech Services. Change-of-mind exchanges may be accepted subject to product availability and condition.
  • All items must be unused, in original packaging, and returned with an approved Return Material Authorisation (RMA).
  • If a replacement product is not available, a refund or store credit may be offered.
  • Some items such as special-order products, software licences, and clearance items may not be eligible for exchange.
  • We comply with the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
  • All warranty claims are subject to the manufacturer’s or distributor’s warranty terms.
  • Proof of purchase is required for all warranty and return claims.

8. IT Services

  • IT support, installation, configuration, consulting and labour charges are non-refundable once work has commenced.
  • Additional work outside the original scope may incur additional charges.
  • We do not guarantee uninterrupted service due to third-party providers, software vendors or internet services.

9. Website, Cloud & Microsoft 365 Services

Where we provide website, hosting, cloud, Microsoft 365 or related services:

  • We are not responsible for outages caused by third-party providers.
  • Customers remain responsible for the content of their websites and online services.
  • Customers are responsible for maintaining appropriate backups unless a managed backup service has been agreed in writing.
  • We do not guarantee search engine rankings, website traffic, sales or business growth.

10. Customer Responsibilities

Customers agree to:

  • Provide accurate information.
  • Maintain secure passwords and login credentials.
  • Ensure all supplied content, images, logos and trademarks are owned or licensed for use.
  • Comply with all applicable New Zealand laws.
  • Maintain their own backups unless otherwise agreed.

11. Third-Party Products & Services

Some services rely on third-party providers including cloud platforms, payment gateways, hosting providers, software vendors and distributors.

Gill Tech Services is not responsible for outages, service interruptions, pricing changes, warranty decisions or failures caused by third-party providers.


12. Limitation of Liability

To the maximum extent permitted by New Zealand law:

  • Our products and services are provided in good faith.
  • We do not guarantee uninterrupted or error-free services.
  • We are not liable for indirect, incidental or consequential loss including loss of profits, business interruption, data loss or loss of revenue.
  • Our total liability is limited to the value of the products or services supplied.

13. Right to Refuse or Suspend Service

We reserve the right to refuse, suspend or terminate services where:

  • Payment is overdue.
  • Illegal, fraudulent or abusive activity is identified.
  • Services are used for spam, malware, cyber attacks or unlawful purposes.
  • Customers breach these Terms & Conditions.

14. Privacy

We handle personal information in accordance with the Privacy Act 2020 (New Zealand) and our Privacy Policy.

Customer information is used only for providing services, processing orders, customer support and meeting our legal obligations.


15. Force Majeure

We are not responsible for delays or failure to perform our obligations due to events beyond our reasonable control, including supplier shortages, courier delays, natural disasters, power outages, internet failures, cyber incidents or government actions.


16. Governing Law

These Terms & Conditions are governed by the laws of New Zealand.


17. Changes to These Terms

We may update these Terms & Conditions at any time. The latest version will always be published on our website.


18. Acceptance

By requesting a quotation, purchasing products, making payment or using our services, you acknowledge that you have read, understood and agree to these Terms & Conditions.
